Terms and conditions

These terms and conditions apply to your purchase of all training sessions and/or consultations.

 

Terms and Conditions

​

  • These terms and conditions form part of your Agreement with Elite Training & Nutrition. This Agreement with Elite Training & Nutrition is made up of your completed and signed waiver, questionnaire, and/or health history, and these terms and conditions displaying the terms of facility and session use. These documents together form a legal Agreement between us, so please make sure that you read them carefully and understand them. If you have any questions, please ask a member of our team.

  • Your instructions to begin training will constitute acceptance of these Terms and Conditions and when you will become a client (a “Client” or “you”). You are asked to pay special attention to the provisions related to cancellations.

  • All Client information will be kept strictly private and confidential.

  • While your Trainer possesses medical knowledge, they cannot prescribe treatment or diagnose medical conditions. They may at any time ask to consult with your private medical professional should any medical condition arise.

  • You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training session. If needed, your Trainer may require a letter of ‘medical clearance’ from your private medical professional. You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

  • You understand that there are inherent risks in participating in strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer and/or Elite Training & Nutrition (referred to as Company) is not responsible, except where the injury was caused by its gross negligence or intentional act. The Client agrees to indemnify and hold harmless the Company and its Trainer(s) for any injuries, illnesses, and the like experienced as the result of the Client’s Training Sessions. Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

  • If you bring children or minors to the Session(s) they remain your responsibility throughout and the Trainer cannot be held liable.

  • While the Company and its Trainer(s) fully believe exercise, specifically exercise personalized to the Client, is beneficial to the Client’s health and wellness, the Company and its Trainer(s) cannot “guarantee” the results of Training Sessions. The Company and its Trainer(s) make no representations and/or warranties that the Client will lose weight, gain muscle mass, be able to engage in any specific physical and/or athletic activity, or will attain any other particular and/or specific results. The Company and its Trainer(s) strongly encourage the Client to follow a healthy diet in conjunction with training and continued exercise.

Sessions, Bookings, Purchases, Cancellations

​

  • The Trainer will provide instruction, advice, supervision, and support needed within an individual or group setting (“Training Session” or “session”). Training Sessions may include but are not limited to, the following activities: testing of physical fitness; exercise; aerobics and aerobic conditioning; cardiovascular training; weightlifting and training; and stretching. These sessions can last anywhere from 30 minutes to 60 minutes, unless otherwise stated.

  • Purchases

  • Session purchases can be made online or in person through any of our specified methods by contacting the lead trainer or facility manager.

  • Session bookings must be made with the assistant, facility manager, or lead trainer.

  • When you purchase your session, you can request your preferred choice of Trainer. You will be contacted within 24 hours of your purchase, and we will inform you if we can accommodate your request or discuss your personal goals and allocate a Trainer who fits your requests. If unsatisfied, the Client may request a new Trainer and the Company will make every effort to accommodate if circumstances allow. If the client begins with the new trainer and remains unsatisfied, the client has the option to be refunded for the remainder of the unused sessions. In all circumstances, any sessions used with the previous Trainer(s) will remain used.

  • All payments must be made in full before any sessions being undertaken.

  • All training sessions must be used within the calendar month to which they relate. Any such sessions not used within the calendar month will be lost without any refund and may not be carried over into the following months. It will be up to the client to "make up" any sessions missed within that calendar month before the end of that calendar month. "Make-up" sessions will be scheduled based on trainer availability and workload. In the event that the trainer has no availability, these "make-up" sessions will be at the discretion of the facility manager.

  • If there is a multi-month commitment (e.g., anything to exceed 1 consecutive month), the payments may be withdrawn via direct debit. The commitment must be completed before you will be entitled to cancel any sessions, or any refund payments can be made. Direct Debit is preferred but other options may be discussed and used as an alternative to direct debit (e.g., upfront payment, scheduled payments, etc.). These other options will be at the discretion of the facility manager or lead trainer.

  • For multi-month commitments, we want to ensure your direct debit starts by the 1st day of the following month, so you will need to have completed this Agreement online or to have signed and submitted this Agreement in person, in either case by the 15th day of the current month. Payment will be taken on the 1st day of the month unless specified at the beginning of sessions.

  • If you want to cancel or change your direct debit you must tell us about the change before the 15th day of the month.

Cancellation of Training Session

​

  • The Client shall provide at minimum a twenty-four (24) calendar hour notice of any necessary cancellation of a scheduled Training Session. Failure to provide a twenty-four (24) calendar hour notice shall result in the Client being charged the full rate for the canceled/missed Training Session. In the event of severe sickness, severe weather, death of a relative, severe injury, or family/personal emergency, the client will have the chance to reschedule, and the client will NOT be charged the full rate for the canceled/missed Training session.

  • The Company and its Trainer(s) will endeavor to provide the Client a twelve (12) calendar hour notice of any scheduled Training Session that may need to be canceled; however, there may be instances where this is not practicable. If either occurs, the client will have the chance to reschedule, and the client will NOT be charged the full rate for the canceled/missed Training session.

Lateness

​

  • If you are late for your session, your session will be reduced in accordance with that time. If you are more than 25 minutes late, your Trainer may choose to cancel the session and you may lose that session, in which case no refund will be made.

  • Expirations and Extensions

  • All Personal Training packs purchase options have a 30-day expiration unless specified for a longer period in increments of 30 days (e.g., 60 days, 90 days, 120 days), after which time any unused sessions will be lost and no refund will be made. This is to ensure we deliver all your required sessions to enable you to achieve your goals.

  • You may freeze your session for between one month and 12 full calendar months for the following reasons only:

    •  Pregnancy

    • Serious illness

    • Serious injury

    • Death of a close relative

  • To extend your sessions you must contact the facility manager or lead trainer; we may ask for documentation for our records.

  • Any other extensions are entirely at the discretion of the facility manager.

Refunds

​

  • If you are unsatisfied for any reason with your current trainer, you will be assigned a new trainer to complete the remainder of your sessions.

  • If for any medical reason you are no longer able to complete any Personal Training sessions, you will be given a refund on any outstanding sessions. We may ask for you to provide proof from your private medical professional.

  • If you discontinue sessions without any notification for longer than 30 days, you will not be entitled to a refund.

  • If your Trainer discontinues training with the facility, no refund will be given, and you will be assigned another trainer by the club.

  • Any other refunds are at the discretion of the Facility Manager.

Miscellaneous

​

  • Elite Training & Nutrition has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. Elite Training & Nutrition will notify you of any change. When such a change(s) is made, if dissatisfied you can cancel this Agreement once you have made any payments already due to the Trainer.

  • You are responsible for keeping all your contact information and marketing preferences up to date with Elite Training & Nutrition. Elite Training & Nutrition will only do what you ask it to do, or what you have permitted it to do with any personal or sensitive information held about you.

  • Your training may be filmed, or pictures taken for marketing purposes. Your participation in a Session/Class means you consent to photography, filming, and sound recording, including you as a Client and its use in commercial distribution without payment or copyright. Please make it known if you wish not to be included in any photography and/or marketing content.

  • Dispute Resolution and Legal Fees. If a dispute arises out of this Agreement that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.

  • Legal and Binding Agreement. This Agreement is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding in Georgia.

  • Severability. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or
